1. Subject Matter and Scope
These terms govern the purchase and use of software products provided by digicredo GmbH (Provider). They apply to all applications, add-ins, and digital tools offered by the Provider. The software is primarily intended for the local encryption of data. By purchasing, installing, or using the software, the user (Licensee) accepts these terms.
2. Contractual Partners and Payment Processing
The purchase contract is concluded directly between the Licensee and digicredo GmbH. The Provider uses the service provider Polar.sh (Polar Signals Inc.) for technical payment processing.
- Infrastructure: Polar.sh provides the technical infrastructure for payment processing.
- Invoicing: Invoices are issued by the Provider using this infrastructure.
3. Export Control
The Licensee agrees to use the software exclusively in compliance with all applicable export, re-export, and sanctions regulations.
- No transfer to sanctioned countries or sanctioned individuals.
- No military, weapons-related, or safety-critical use.
- In the event of violations, the Provider may refuse updates and support and may initiate legal action.
4. Usage Rights and Duty of Care
The Provider grants the Licensee a non-exclusive, non-transferable right of use. The license is perpetual.
- The software encrypts data locally; the Provider has no access to content or passwords.
- The Licensee is responsible for the secure storage of their access data. If lost, encrypted content is irretrievably lost.
- Decompiling, modifying, reverse engineering, or transferring the license to third parties is prohibited.
5. Activation and Data Protection
The software is executed locally. Data transmission to the Provider is limited to the following technical requirements:
- License Validation: A one-time internet connection is required for the initial activation. During this process, only the license key and the associated email address are transmitted.
- Offline Operation: Following successful activation, the software operates entirely offline. No user data, passwords, or encrypted contents are transmitted to the Provider or any third parties.
- Local Processing: All encryption and decryption processes occur exclusively on the Licensee’s local hardware. The Provider has no technical access to the processed data or the passwords used.
6. Expiration of the Right of Withdrawal
The software is provided as digital content. The statutory right of withdrawal expires prematurely once the license key has been provided, provided that the Licensee has expressly agreed during the checkout process that the execution of the contract shall begin before the expiry of the withdrawal period and that they thereby lose their right of withdrawal.
- The purchase can only be completed if the corresponding checkbox has been activated.
- Consent is displayed in the order confirmation.
7. Refunds
- Refunds are possible in the event of justified defects or technical problems.
- Requests are generally answered within 30 days; in the event of an extension, a notification with reasons will be provided. To verify requests, digicredo may cross-reference transaction-related data with Polar.sh.
8. Warranty and Limitation of Liability
- The software is provided "as is." No guarantee is given for complete error-free operation or suitability for specific purposes.
- No liability is accepted for data loss resulting from password loss, hardware defects, or improper operation.
- The Provider's liability—except in cases of intent or gross negligence—is limited to the purchase price paid by the Licensee.
- In cases of slight negligence, the Provider is only liable for the breach of essential contractual obligations; in this case, liability is limited to the contract-typical, foreseeable damage.
- Liability for indirect damages, consequential damages, and lost profits is excluded.
- Essential contractual obligations are those whose fulfillment enables the proper use of the software (e.g., provision of the license key).
- Where mandatory law provides for deviating regulations, these shall apply.
9. Version Validity and Update Obligation
The Provider may technically block the use of outdated versions for security or stability reasons.
- Standard Version: May require an update for continued use.
- Pro Version: Remains functional unless safety-critical reasons make deactivation mandatory.
10. Third-Party Components
The software uses locally executed open-source components (e.g., 7-Zip, Copyright © Igor Pavlov). The respective open-source licenses remain unaffected.
- Third-Party Executables: Included files (e.g., 7zr.exe) may be co-signed by digicredo GmbH for distribution integrity purposes.
- Authorship: This signature does not imply authorship or modification of the original software.
- Source Code: Source code for 7-Zip is available at https://www.7-zip.org/.
11. Final Provisions
- Swiss law shall apply.
- The place of jurisdiction is Bern, Switzerland.
- Should individual provisions be invalid, the validity of the remaining provisions shall remain unaffected.
