Terms & Conditions / License Agreement
1. Subject and Scope
These Terms and Conditions govern the purchase and use of the software products provided by digicredo GmbH, Greyerzstrasse 79, 3013 Bern, Switzerland (“Provider”). They apply to all applications, add ins, and digital tools offered by the Provider. By purchasing, installing, or using the Software, the user (“Licensee”) accepts these Terms.
2. Contracting Party and Payment Processing
All purchases are processed through an authorized payment partner acting as the Merchant of Record. This partner is responsible for payment processing, invoicing, and tax compliance. We do not store or process any payment information on our website. The terms and conditions of the respective payment partner apply in addition to these Terms.
3. Software License (EULA)
The Provider grants the Licensee a non exclusive, non transferable right to use the Software. Unless otherwise stated at the time of purchase, the license is perpetual.
Restrictions
The Licensee may not:
- decompile, reverse engineer, modify, or distribute the Software
- sublicense or transfer the license to third parties
Activation
A one time internet connection is required to validate the license key. Only the data necessary for license verification (license key and associated email address) is transmitted. After successful activation, the Software does not require a continuous internet connection.
4. Right of Withdrawal for Digital Content
The Licensee acknowledges that the Software is digital content delivered by providing a license key. The statutory right of withdrawal expires prematurely once the license key has been provided, provided that the Licensee has:
- expressly consented to the execution of the contract before the end of the withdrawal period, and
- confirmed awareness that this consent results in the loss of the right of withdrawal.
Details are governed by the Provider’s separate Cancellation Policy.
5. Warranty and Limitation of Liability
The Software is provided “as is.”
- The Provider does not guarantee that the Software is entirely error free.
- Liability for indirect or consequential damages, including loss of profit, is excluded to the extent permitted by law.
- In any case, the Provider’s liability is limited to the amount paid by the Licensee for the Software.
6. Support and Maintenance
The Provider is not obligated to provide technical support, updates, or maintenance. Any assistance beyond the provided documentation is voluntary and at the Provider’s discretion.
7. Third Party Components
The Software includes certain open source components that are embedded in the installation package. These components run locally only and do not transmit any data to the Provider or to third parties.
Included component:
- 7 Zip (Copyright © Igor Pavlov) – used for local extraction during installation. License: GNU LGPL / unRAR restrictions (https://www.7-zip.org)
The use of these components does not affect the licensing terms of the Provider. The respective open source licenses remain in full force.
8. Use of External SMS Services
The Software allows the integration of external SMS service providers. When using such services, the terms and conditions of the respective provider apply exclusively. The Licensee is solely responsible for complying with these terms and for the lawful use of any SMS‑related functionality.
9. Final Provisions and Jurisdiction
- If any provision of these Terms is or becomes invalid, the remaining provisions remain unaffected.
- Swiss law applies.
- The place of jurisdiction is Bern, Switzerland.
